       Note;
This soldier is included in this study as the records were found in the Maquon Library.   At this time it is unknown how they came to be there or what his connection is with the town of Maquon.   As he is listed with the 53d Ill. Cav. a search of military records is no help as there was no 53d Ill. Cav. during the Civil War.   I have therefore searched the most likely regiments.   I have included these even though I have no proof that they are in fact those listed in the charges.
HEAD QUARTERS, DEPARTMENT OF THE MISSISSIPPI
Corinth, Miss., July 16, 1862
GENERAL ORDERS,   NO. 39
       I.......   At the General Court Martial which convened at Corinth, Mill., pursuant to Specila Field Orders No. 126, and of which Captain Wm. FORD, 53d Illinois Cavalry, is President, were tried:
CHARGE;
"Disobedience of orders."
       SPECIFICATION; "In this, that Private John L. Barber, 53d Illinois Cavalry, being ordered on the 12th day of June, 1862, at Camp of Major General Halleck's escort, Corinth, Mill., by Captain John S. Foster, commanding escort of Major General Halleck, to report to Captain W. Willard Smith, Acting Assistant Quartermaster, Major Genral Halleck's staf, for police duty, did, at the time and place aforesaid, refused to obey szid order, thereby disobeying the lawful command and order of his commanding officer, the said Captain John S. Foster, and violating a part of the 9th Article of War."
       To which the charge and specification the prisoner pleaded "Not guilty."
FINDING OF THE COURT;
       The Coutrt finds the prisoner, Private John L. Barber, 53d Illinois Cavalry, "Not guilty" of the charge ane specification.
       The findings of the Court in the cases of Privates George M. Leland and John L. Barber, 53d Illinois Cavalry, are not in accordance with the recorded evidence.   The Court grossly neglected its duty in not punishing the parties they proved guilty of disobedience of orders.   Such a course directly encourages mutiny.   Privagtes George M. Leland and John L. Barber will be released frp, arrest amd returned tp duty.
